Rental terms
1. Scope and formation of the contract
These rental terms describe the general PRESTIVEX process for self-drive vehicle rental. Sending an enquiry does not create a contract. A booking becomes binding only once the individual offer has been accepted and the rental agreement has been concluded. The individual documents specify the vehicle, period, price, mileage, deposit, insurance and any agreed extras.
2. Reservation, cancellation and no-show
Availability is checked for every enquiry. The cancellation and no-show rules sent with the individual offer apply after a binding booking. If plans change, the renter must contact PRESTIVEX without delay. No general percentage or fee applies unless it has been stated in the accepted offer or rental agreement.
3. Drivers and required documents
Only drivers named and approved in the rental agreement may drive. Each driver must meet the vehicle-specific minimum age and licence-history requirements and present an original valid driving licence plus ID card or passport at handover. For licences from third countries or without Latin script, PRESTIVEX confirms in advance whether an international driving permit or certified translation is required.
4. Handover, return and extension
The exact meeting point and time are confirmed by email. Vehicle condition, prior damage, mileage and fuel or charge level are recorded together. A different return place, late return or extension is effective only after prior confirmation by PRESTIVEX. The vehicle, keys, documents and supplied accessories must be returned as agreed.
5. Permitted use, mileage and cross-border travel
The vehicle is supplied exclusively for lawful self-drive use. Smoking, racing circuits, motorsport, driver training, commercial passenger transport, subletting and use by an unapproved driver are prohibited. The agreed mileage and published additional-kilometre rate apply. Every country on the planned route must be approved in writing before handover.
6. Price, deposit and payment
The accepted offer states the gross rental price, payment method and deposit. The deposit is separate from the rental price and serves as security for claims connected with the rental. PRESTIVEX initiates its release after the documented return; the card issuer or bank determines when the amount becomes visible again.
7. Insurance and renter responsibility
The applicable insurance, excess, exclusions and duties are stated in the rental agreement and insurance information. A deposit is not an insurance premium and does not replace the renter’s duties. Deliberate acts, grossly negligent breaches or use contrary to the agreement may affect cover as provided by law and the signed documents.
8. Accident, damage, breakdown or theft
Accidents, new damage, breakdowns, theft, warning messages and loss of keys or documents must be reported immediately. The scene and evidence must be secured, no admission of liability may be made, and PRESTIVEX instructions must be followed. Police must be contacted whenever required by law, the circumstances or PRESTIVEX.
9. Fines, tolls and return-related costs
Fines, tolls and parking charges caused during the rental remain the renter’s responsibility. Charges for missing fuel or charge, exceptional cleaning, missing equipment, unauthorised use or administrative work are due only where agreed in the rental documents or legally recoverable. The actual circumstances and supporting records remain decisive.
10. Withdrawal for date-specific vehicle rental
German law generally provides no statutory fourteen-day right of withdrawal for a vehicle-rental service agreed for a specific date or period under section 312g(2)(9) BGB. Any expressly agreed cancellation option and mandatory consumer rights remain unaffected.
